Eligibility for Chapter 7 Bankruptcy
Chapter 7 bankruptcy, often referred to as liquidation, is based on income qualifications. In a chapter 7, many debts that you cannot be pay will be eliminated.
Your income and debts will be put through a means test to determine if you are eligible for chapter 7. If you are not, you may be able to file for a chapter 13 bankruptcy, instead.
Filing for Chapter 7 Bankruptcy
At our office, we help you through all aspects of filing for bankruptcy, from completing necessary paperwork to attending hearings.
Prior to filing for a chapter 7 bankruptcy, you will be required to attend an approved credit counseling course. Once you file, a hearing will be scheduled to go through your debts and assets. Following your hearing you will need to attend an education counseling course that details life after bankruptcy. Then, usually within four months, a discharge of your debts will be granted.
Chapter 7 Bankruptcy Fees & Costs
Our fees for a chapter 7 bankruptcy are on a sliding scale and start at $750.00. The following schedule applies to Chapter Seven cases filed after November 1, 2011 in the Central District. The Attorney fee charged for the case is based on monthly household income:

| Less than | $3500 | $1600 |
| Less than | $4000 | $1800 |
| Less than | $4500 | $2000 |
| Less than | $5000 | $2200 |
Restrictions: The above fee schedule applies when unsecured debt is less than $50,000.00 and there are fewer than twenty creditors. If unsecured debt is over $50,000.00 or there are more than twenty creditors, the above schedule will not apply.
In addition to the above attorney fee, client will be required to pay all court cost (Filing fee – Currently $299.00) and a credit report fee (Currently 28.00 for single/ $48. for joint).
Credit Counseling (Currently $25.00) and Client Education (Currently $15.00). Copy and Postage Charge $50.00.
The above schedule does not apply to cases requiring amendment or cases that are continued due to client.
Emergency filings will be surcharged a minimum of $250.00
