Chapter 13 Bankruptcy

Chapter 13 bankruptcy has a slightly different process than chapter 7 bankruptcy. Most people who are eligible to file a chapter 13 bankruptcy are trying to save their homes from going into foreclosure. Once the automatic stay is filed, all proceedings against the debtor must stop.

Chapter 13 bankruptcy establishes priority among your creditors. You develop an approved repayment plan to pay priority creditors. The repayment plan can span over the period of three to five years. Following completion on your plan, remaining debts are discharged, or eliminated.

Establishing a Payment Plan

Within 15 days of filing a petition for bankruptcy, you must file a plan for payment of debts. Your payment plan needs to be realistic.

You plan determines how much you can feasibly pay each month to your creditors. Once the plan is approved by an appointed trustee, you can begin paying off your debt. You will make monthly payments to your trustee, who, in turn, pays your creditors.

It is important remember that house payments are made outside of the plan. However, second mortgages may be part of the debt that is discharged at the end of your plan.
